Nibble Terms and Conditions
1. Introduction
- Welcome to Nibble T/A Umami Digital Limited. These terms and conditions govern your purchase of the setup fee and the initial design services provided by us, which are aimed at creating potential website design solutions and mock-ups for your review.
2. Setup Fee
- A mandatory setup fee is required to commence our services. This fee is non-refundable and covers the initial consultation, planning of potential website solutions, and the creation of mock-ups.
- The amount of the setup fee is £250 and must be paid in full before any work begins.
3. Services Provided
- Upon receipt of the setup fee, we will schedule a kickoff call to discuss your website needs and preferences.
- We will provide a set number of design mock-ups, based on the package selected, which will be delivered in the kick-off call no earlier than 5 working days after paying the setup fee.
- Feedback on the initial mock-ups must be provided within 2 working days to ensure timely progression to the subscription phase.
4. Subscription Services
- Following approval of the initial mock-ups, you will be invited to sign up for our ongoing subscription services. Details of these services, including scope, pricing, and terms, will be provided separately.
- The monthly subscription cost provided on the website is exact based on the criteria selected, however, can be amended during consultation on the kick-off call if we discover your needs are different from selected.
5. Intellectual Property
- All design mock-ups and related materials provided during the setup phase remain the intellectual property of Nibble T/A Umami digital Limited until a subscription agreement is signed, and full payment is received.
6. Cancellation and Refunds
- The setup fee is non-refundable. Should you choose to cancel your service after the kickoff call but before moving to the subscription phase, no part of the setup fee will be refunded.
- Nibble T/A Umami Digital Limited reserves the right to cancel the service at any point due to unforeseen circumstances. In such cases, a prorated refund of the setup fee may be considered at the discretion of Nibble T/A Umami Digital Limited.
7. Limitation of Liability
- Nibble T/A Umami Digital Limited will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the service.
8. Amendments to Terms and Conditions
- Nibble T/A Umami Digital Limited reserves the right to modify these terms and conditions at any time. Your continued use of our services following any such modifications constitutes your acceptance of the new terms and conditions.
9. Governing Law
- These terms and conditions are governed by the laws of The United Kingdom, and any disputes will be subject to the exclusive jurisdiction of the courts of that location.
